The German cannabinoid market has seen more changes in the last two years than in the previous ten. First the HHC ban in June 2024, then the ban on THCP – and new substances popping up all the time, raising questions. The legal basics – explained briefly

In Germany, two laws decide what you can and can't do with cannabinoids:

  • Narcotics Act (BtMG): The classic drug law. THC, classic opioids, cocaine – everything listed here is strictly banned. Cannabis as a plant and THC are included, but there are exceptions thanks to the Cannabis Act (CanG) since April 2024.
  • New Psychoactive Substances Act (NpSG): The more modern law that covers synthetic and semi-synthetic psychoactive substances. HHC and THCP were added here in 2024. The NpSG acts as a safety net: a substance doesn't have to be listed individually – it falls under the law if it matches the defined structure of a banned group of substances.

The Federal Ministry of Health regularly publishes updates to both laws. For cannabinoids, the NpSG is especially important, since its 5th amendment (2024) covers several new cannabinoid structure classes.

Why were HHC and THCP banned?

Starting around 2022, HHC was the most popular legal cannabinoid in Germany. The market grew fast – too fast for lawmakers. In June 2024, HHC was added to the 5th amendment of the NpSG after:

THCP followed soon after – because of its extremely high potency (up to 33 times stronger than THC) and the associated risk potential.

What makes a cannabinoid legal?

For a cannabinoid to be legally sold in Germany, the following requirements basically have to be met:

  • Not listed in the BtMG – not a direct narcotic
  • Not covered by the NpSG – neither as an individual substance nor by structural features of a banned substance group
  • Made from EU-certified industrial hemp – THC content in the final product under 0.2%
  • Not a food or medicine – Cannabinoid Vapes are declared as technical products, not for consumption
  • Buyer must be of legal age – all legal sellers are required to check age

How do you spot a reputable seller?
