What is the NpSG?

The New Psychoactive Substances Act (NpSG) is a German federal law that has been in effect since November 2016. It was specifically created to stop the trade of new psychoactive substances that aren't covered by the Narcotics Act (BtMG). Unlike the BtMG, the NpSG covers entire groups of substances instead of individual compounds.

Important: The NpSG is very different from the BtMG. There's no "small amount" rule like with cannabis. Still, in practice, authorities mainly focus on the trade, not end consumers.

Why was HHC banned?

The German government gave several reasons for the HHC ban:

  • Psychoactive effects: HHC has effects similar to THC and was classified as an intoxicant
  • Lack of regulation: HHC products weren't subject to quality control, dosing standards, or age restrictions
  • Rapid market growth: The HHC market grew rapidly in 2023/2024, especially for Vapes and edibles
  • Health risks: The Federal Institute for Risk Assessment (BfR) saw potential health risks from uncontrolled products

Will HHC become legal again?

Right now, there are no political efforts to reverse the HHC ban. Substances added to the NpSG usually stay there permanently. Legalization would only be possible through an explicit decision by the federal government – similar to the partial cannabis legalization (KCanG), which only applies to cannabis with THC.

Realistically, HHC won't become legal again. However, cannabinoid research has moved forward, and legal alternatives like HHZ offer similar experiences.

Can the police detect HHC?

Yes. HHC and its metabolites can be detected in the following tests:
